Commercial Tenancy Dispute: Rent Reduction and Instalments

Client requirements

A business owner in Dubai faced financial difficulties and fell behind on rent for commercial premises. The landlord began rental dispute proceedings. Works associated with Dubai Municipality had adversely affected the business, making official records of the disruption important to the client’s position.

The challenge

The client needed to present the relevant circumstances through the appropriate legal process, support the case with official records and seek a workable arrangement for accumulated rent.

Our contribution

Our first task was to collect and organise official documents concerning the municipal works and their effects on the business. These records were relevant to explaining the circumstances behind the client’s difficulties. We brought the material together for the client’s appointed lawyers to assess alongside the rental obligations in dispute.

We coordinated delivery of the documents to an independent law firm selected and retained by the client. The law firm assessed the legal position, provided advice, prepared the legal memoranda and handled submissions and representation in the proceedings. Ras Al Hekma’s involvement remained administrative, with document collection and coordination supporting the work of the appointed legal team.

Our team continued the administrative follow-up as the outstanding rental obligations were addressed. The reduction and instalment arrangement described below arose from this client’s documented circumstances and the proceedings in this case. They should not be understood as a promised result for another commercial tenancy dispute.
